These Terms & Conditions govern Your access and use of the online website, interfaces, features and services accessible via https://swiftcred.eu online platform and services, owned and operated by:

THESE T&C ARE PREDOMINANTLY AIMED AT REGULATING USE OF THE SWIFTCRED.EU PLATFORM BY USERS.

These Terms & Conditions apply to the sale of digital goods (digital certificates, game keys, gift cards and coupons) by Merchants and the https://swiftcred.eu operator.

All information we collect about you through the Platform is subject to SWIFTCRED.EU’s Privacy Policy

VAT AND TAXATION INFORMATION

  • Consumers within the European Union:
    VAT will be charged in accordance with the tax laws applicable in the EU member state where the customer is resident.
  • Merchants within the European Union:
    VAT will not be charged directly by SWIFTCRED.EU. Businesses are required to account for VAT under the reverse-charge mechanism, pursuant to EU VAT regulations.
  • Users outside the European Union:
    VAT or equivalent taxes are not applicable to transactions processed through SWIFTCRED.EU, subject to the tax laws applicable in the customer’s country of residence.

SWIFTCRED.EU commits to adherence to tax regulations as applicable and will update these provisions to reflect any changes in law or tax regulations affecting electronic services. Customers are advised to consult local tax advisors to understand their tax obligations.

1. DEFINITIONS

1.1. Account – a User’s account at SWIFTCRED.EU Platform, available after registration and login.
1.2. Buyer – any User who buys Products via the Platform. Buyers include Consumers and Merchants.
1.3. Consumer – any user who uses the Platform acting for personal purposes, outside that person’s trade, business, craft, or profession and not for profit.
1.4. Determination – SWIFTCRED.EU’s decision regarding disputes between a Buyer and Seller in the Resolution Center.
1.5. External Content – goods and services, including digital goods and services such as product codes, software, subscriptions, closed-loop vouchers and gift cards, which may be accessed at External Platforms by using (redeeming) the Product purchased via the Platform. For the avoidance of doubt.
1.6. External Platforms – third-party platforms where Products can be used to access External Content, based on the Product’s description.
1.7. Guest User – a User using the Platform without a logged-in Account (i.e., a User who does not have an Account or has not logged in to their Account).
1.8. SWIFTCRED.EU – GoldFort OÜ, Established under the laws of the Republic of Estonia, Registration number 14748334, Registered address Harju maakond, Tallinn, Kesklinna linnaosa, Narva mnt 7b, 10117, operator of the Platform.
1.9. SWIFTCRED.EU Balance – represents the accumulative value of each respective User’s receivables owed by SWIFTCRED.EU and tied with each User’s Account (e.g., receivables due to Sellers from the sale of Products on the Platform).
1.10. Merchant – a professional User, i.e., a User who uses the Platform in direct relation to their business activities, in particular for profit, in a repetitive and organized manner. This includes all Sellers, resellers (Users who purchase Products with the intention of reselling them, including via the Platform), wholesale Buyers (Users purchasing Products in bulk), and API partners (partners connecting with SWIFTCRED.EU API to automate trading of Products).

For avoidance of doubt, a person making a single purchase of a Product to use in their business activity unrelated to trading (e.g., an accountant purchasing accounting software) is not considered a Merchant.
1.11. Platform – the online website, interfaces, features, and services of the SWIFTCRED.EU marketplace platform, available at: https://swiftcred.eu
1.12. Products – digital keys or access data, available for purchase on the Platform and allowing access to External Content at External Platforms.
1.13. Resolution Center (support) – Platform functionality where Users may request refunds, submit complaints, raise claims, and resolve issues or disputes arising out of their use of the Platform.
1.14. Seller – any User who sells Products to Buyers via the Platform. Only Merchants may be Sellers. SWIFTCRED.EU does not allow Consumers to sell Products on the Platform.
1.15. Service Fee – a fee due to SWIFTCRED.EU.
1.16. T&C – these Terms & Conditions, along with all appendices.
1.17. Users or “You” – any person (natural or legal) who uses the Platform, including Guest Users, Buyers, Sellers, Merchants, or persons browsing the Platform without transacting, subject to Section 3 of these T&C.

2. MAIN TERMS

2.1. These T&C govern Your use of the SWIFTCRED.EU Platform, whether You are a Buyer, Seller, registered User, Guest User, Consumer, entrepreneur, or a legal entity simply browsing the Platform without making any transaction.

2.2. SWIFTCRED.EU provides technological and organizational infrastructure to support:

  • discovery of Products;
  • matching Buyers and Sellers;
  • facilitating transactions (incl. payment, delivery, dispute resolution).

SWIFTCRED.EU is not a party to transactions between Users and does not directly sell Products unless explicitly stated. It does not guarantee or assume responsibility for fulfillment, but may facilitate issue resolution via the Resolution Center (Section 14).

2.3. Additional Clarifications:

2.3.1. SWIFTCRED.EU is not affiliated with Users. It is not a shareholder, agent, or representative of Buyers or Sellers. All Users voluntarily use the Platform.

2.3.2. Unless otherwise stated, SWIFTCRED.EU is not affiliated with Product publishers, developers, issuers, or distributors. Partnerships with External Platforms may exist but are not universal.

2.3.3. All Products are delivered as unique digital keys to redeem on External Platforms. Sellers are responsible if Products do not work as described.

SWIFTCRED.EU and Sellers provide no warranties regarding External Content. Issues should be directed to the External Platform.

Disclaimer: To the extent permitted by law, SWIFTCRED.EU disclaims liability for actions, omissions, or terms of External Platforms.

2.3.4. Products’ availability and pricing are controlled solely by Sellers. SWIFTCRED.EU does not guarantee or influence their decisions.

2.4. User Protection

SWIFTCRED.EU implements the following safeguards:

2.4.1. Contractual Requirements for Sellers: Quality, functionality, legality, and compliance obligations for listed Products.

2.4.2. Random Control Checks.

2.4.3. Merchant KYC Checks: Identity and legitimacy verification of Merchants.

2.4.4. Monitoring Seller Performance: Based on complaints, refund rates, chargebacks, etc. May result in warnings or account actions.

2.4.5. Limitation: SWIFTCRED.EU does not guarantee quality or fulfillment for all Products. Use due diligence.

2.5. All Platform transactions are governed by these T&C. Merchant-specific terms may exist but these T&C prevail in case of conflict.

2.6. These T&C set general rules. Specific services (e.g., marketing, merchant services) may be governed by separate terms.

2.7. Platform availability is targeted at 90%. Outages may occur due to external events or maintenance. Scheduled maintenance typically happens at night (CET/CEST).

2.8. Using the Platform (account creation, browsing, cart use) is free.

2.9. Platform functionality, availability, and fees may differ by region due to local laws.

2.9.1. Persons in sanctioned jurisdictions are prohibited from using the Platform.

2.9.2. Regional Adjustments May Include:

  • a. Age restrictions
  • b. Extra identity verification
  • c. Consent requirements
  • d. Access limitations
  • e. Legal compliance changes affecting availability

2.10. Before buying, Users must carefully read Product descriptions. Access to External Content may be restricted by device, account, region, language, or currency. Sellers must ensure the Product matches its description. 

2.11. Users are responsible for following all laws and platform policies. SWIFTCRED.EU does not offer legal guidance.

2.12. Online transactions involve risks: hacking, malware, fraud. Users should take precautions (e.g., antivirus, secure passwords).

In case of issues — contact Customer Support.

2.13. SWIFTCRED.EU reserves the right to:

  • Investigate suspected security breaches;
  • Cooperate with authorities;
  • Prosecute violations of these Terms.

2.14. SWIFTCRED.EU may terminate a User’s Account:

  • as per Section 13, or
  • due to Platform discontinuation in a jurisdiction (with at least 15 days’ notice).

2.15. Responsible Use
In-Game Goods are for entertainment only — not gambling or speculation. 

3. USERS

3.1. Eligibility
The Platform is available to the following categories of Users:

3.1.1. Consumers aged 18+ or of legal age in their jurisdiction, with full legal capacity.

  • Minors may use the Platform only with guardian consent, to be submitted via Customer Support (see Section 15).

3.1.2. Legal entities (e.g. Merchants) properly registered and represented under the laws of their jurisdiction.

  • Additional conditions may apply under separate agreements.

3.2. Account Registration
To access full Platform functionality, Users must create and log in to an Account.
Guest Users have limited functionality.

3.3. User Verification

3.3.1. Buyers

  • SWIFTCRED.EU receives the necessary information from users – first name, last name, address, e-mail, phone number.

3.3.2. Merchants

  • Sellers undergo mandatory verification before being allowed to sell.
  • Required documents: valid ID, business registration, tax information, etc.

3.3.3. Accuracy of Information

  • All Users must provide truthful and complete information.
  • False data may result in account suspension, termination, or legal action (see Section 13).

3.4. Merchant-Specific Documentation
Merchants may be asked to submit and update:

  • Company name, registration number, legal address, tax ID;
  • Official registration documents;
  • Any other documents deemed necessary.

SWIFTCRED.EU may request updates at any time to ensure compliance and detect fraud.

4. ACCOUNT

4.1. Creating an Account
By registering an Account on SWIFTCRED.EU, You enter into a user agreement with the Platform.

To register, You must:

  • Confirm acceptance of these Terms and be of legal age in Your jurisdiction;
  • Provide the required information via the Platform;
  • Activate Your Account via confirmation link sent to Your email (if not activated in time, the process must be repeated).

4.2. Data Accuracy
All registration data must be truthful, accurate, and current.

5. PURCHASE & PAYMENT

5.1. General Purchase Rules

This section outlines purchase rules.

5.2. Merchant Transactions

Merchant transactions are governed by separate terms.

Standard Purchases

5.3. Making a Purchase
To purchase a Product:

  • Add the Product to the cart;
  • Choose a payment method;
  • Confirm payment.

The sale contract is concluded upon successful payment.

5.4. Confirmation Emails
You’ll receive an order confirmation and later a payment confirmation email.

5.5. Payment Details

  • 5.5.1. Payment is considered complete once our payment provider confirms the transfer.

5.6. Payment Decline
If your payment is declined, the Product is reserved for a limited time. After that, the order is automatically canceled.

5.7. Payment Methods
Available payment methods may vary by region, payment provider, and Product. You may need to accept the provider’s terms. SWIFTCRED.EU use Payment Methods, specified at SWIFTCRED.EU platform. 

5.8. Guest Checkout Requirements

  • Confirm acceptance of T&C and age;
  • Provide a valid email (required for delivery and compliance, e.g., AML regulations);
  • Your email is processed in line with our Privacy Policy.

5.9. Delivery

  • Sellers must deliver on the release day.
  • If delivery fails, SWIFTCRED.EU may issue a warning or limit the Seller’s ability to offer pre-orders.
  • Repeat failures may result in account restrictions.
  • Sellers have 14 days to challenge decisions.
  • Delivery is made to the buyer’s e-mail address.

Crypto Payments

5.10. Paying with Cryptocurrency
Users may pay in cryptocurrency, but the price is still denominated in EUR/USD/other fiat currency. 

6. PRICES

6.1. Product Prices

Product prices are set on each Product card. 

6.2. Dynamic Price Changes

Prices may change dynamically based on Seller decisions.

6.3. Price Comparisons

Prices displayed across the Platform reflect current offers.
Note for non-consumer EU Buyers: You waive any claims related to outdated or inaccurate comparison pricing.

6.4. Service Fee

Product prices do not include the Service Fee, which is calculated at checkout based on your cart and info.

6.5. Service Fee Details

  • Calculated dynamically at checkout and shown before final confirmation.
  • Reflects platform operation costs (anti-fraud, support, compliance, etc.).
  • May vary based on transaction risk and regulations.
  • Does not include payment system surcharges.
  • No hidden fees are added after checkout.

6.6. Currency Selection

Prices and fees are displayed in the currency selected in the Platform interface. You may switch currencies at any time.

6.7. Final Price Confirmation

Before confirming any purchase, You’ll see the full price, including all applicable fees. No additional charges will follow.

7. DELIVERY

7.1. Standard Products (keys)

  • After payment confirmation, You’ll receive an email.
  • The Product will be accessible via e-mail.
  • You’ll be able to reveal the unique activation key for use on the relevant External Platform.

7.2. Product Redemption

Follow instructions in the Product description to redeem your key — this typically requires an account on the External Platform.

7.3. Confidentiality of Activation Key

  • Keep Your key confidential.
  • If lost, shared, or stolen, it cannot be replaced or refunded.
  • Only enter it on the official platform — ignore any third-party requests.

7.4. Guest Users

  • Guest Users receive their Product via email.
  • If an incorrect or inaccessible email is used, access may be lost. Refunds are not guaranteed, but you can contact support.

7.5. In-Platform Chat (support)

SWIFTCRED.EU provides an in-platform chat to help Users arrange delivery. This chat may be reviewed in case of disputes.

7.6. Delivery Time

Delivery begins once payment is confirmed. Processing usually takes under an hour to 24 hours.

7.7. Order Completion

Once delivery is marked “completed” by the Seller, You’ll be notified:

  • 7.7.1. You have 24 hours to dispute delivery if the Product wasn’t received.
  • 7.7.2. If no dispute is raised, the order is considered complete — but Your rights under consumer law remain intact. If issues arise after the deadline, contact Customer Support.

8. DEFECTIVE PRODUCTS, WITHDRAWAL RIGHTS, PRE-ORDERS AND REFUNDS

Withdrawal Rights

8.1. Cancellation Right

We follow EU consumer protection laws and adapt refund/return rights to other key markets, including the U.S., Canada, Australia, Japan, and others. Local laws on cancellations, guarantees, and dispute resolution apply.

8.2. 14-Day Withdrawal Period

You have 14 days to cancel a purchase without giving a reason, unless stated otherwise.

8.3. Start of Withdrawal Period

The withdrawal window starts from Product delivery. After that, withdrawals may be accepted at our discretion. Contact support.

8.4. Cancellation Process

To cancel, contact us via support, email, or letter. 

8.5. Deadline for Cancellation

Sending Your request before the deadline is enough to meet the withdrawal period.

8.6. Refund Process

If You cancel, we’ll refund the full amount (including taxes and Service Fee), usually within 14 days, using the same payment method (unless otherwise agreed).

8.7. Digital Key Withdrawal

You lose the right to withdraw once You reveal a digital key, as it becomes impossible to verify usage or resell it. The contract is then considered fulfilled.

Defective Products

8.8. Defective Product Claims

If a Product is defective, You may request a replacement (if available).

8.9. Refund for Defective Product

If a replacement isn’t possible, You may receive a partial or full refund, depending on the case.

9. VIOLATION OF TERMS OF USE

9.1. Compliance with Terms

All Users must comply with these Terms & Conditions. This section outlines prohibited actions and the measures SWIFTCRED.EU may take in case of violations.

9.2. Prohibited Actions Include:

  • 9.2.1. Violating these Terms, creating multiple Accounts per User, or breaching licensing terms or refund rules.
  • 9.2.2. Engaging in unlawful sales, including:
    • a) Selling illegal or prohibited Products;
    • b) Selling fraudulently acquired or stolen goods;
    • c) Infringing third-party IP rights;
    • d) Selling defective or misleading Products;
    • e) Exploiting any Platform loopholes or acting against fair commercial principles.
  • 9.2.3. Using the Platform from restricted jurisdictions.
  • 9.2.4. Being underage.
  • 9.2.5. Using SWIFTCRED.EU branding, trademarks, or content without permission.
  • 9.2.6. Impersonating others or misrepresenting identity.
  • 9.2.7. Extracting data (e.g., scraping, bots) without authorization.
  • 9.2.8. Using scripts or programs to disrupt or manipulate the Platform (includes bots, malware, DDoS attacks, or security bypassing).
  • 9.2.9. Compromising system integrity, hacking, intercepting data, or disrupting Platform operations.
  • 9.2.10. Abusing withdrawal or refund systems (e.g., serial refunds, payment fraud, money laundering attempts).
  • 9.2.11. Using stolen or unauthorized payment credentials.
  • 9.2.12. Providing false, incomplete, or misleading information to SWIFTCRED.EU.
  • 9.2.13. Emulating or redirecting SWIFTCRED.EU network features (e.g., protocol emulation or reverse engineering).
  • 9.2.14. Attempting phishing or collecting personal data of other Users under false pretenses.
  • 9.2.15. Engaging in any actions that may cause financial loss or reputational harm to the Platform or its Users (e.g., false reports or unfounded complaints).

9.3. User Responsibility

Users must comply with the above at all times when using the Platform.

9.4. Reporting Violations

If You suspect a violation, You are encouraged to report it to Customer Support. Reports should include a detailed description, relevant information, supporting evidence, and Your preferred contact method. All reports are handled confidentially, and retaliation for good-faith reporting is prohibited.

9.5. Investigation of Violations

SWIFTCRED.EU will investigate suspected breaches using credible information or internal alerts. 

9.6. Minor, One-Time Breaches

Minor, one-time breaches may result in a warning.

9.7. Serious or Repeated Violations

For serious or repeated violations, stricter action may be taken, including account restriction and full review. Users have 14 days to respond and may appeal with supporting evidence.

9.8. Combination of Remedies

Multiple remedies may be combined depending on the severity of the breach.

9.9. Consumer Rights

Consumer rights remain protected, including the right to complaint and dispute resolution. However, blatant spam or bot-related abuse may result in immediate enforcement without full procedure.

9.10. Cooperation with Law Enforcement

SWIFTCRED.EU will cooperate with law enforcement and may disclose User data when legally required.

9.11. INDEMNITY

You agree to indemnify SWIFTCRED.EU and its affiliates against any losses, claims, or costs arising from Your violations, defective Products, or related third-party claims.

10. ONLINE DISPUTE RESOLUTION

10.1. Initiating a Dispute

If you encounter a problem with a Product (such as inability to redeem it), you may initiate a dispute via support.

10.2. Communication with Seller

Once the dispute is opened, a secure communication channel is created between you and the Seller. You may be asked to submit evidence (screenshots, purchase history, etc.). SWIFTCRED.EU monitors disputes to ensure fair conduct.

10.3. Resolution Process

If the Buyer and Seller agree on a resolution (e.g., refund or replacement), the case will be closed accordingly.

10.4. Escalation to SWIFTCRED.EU

If no agreement is reached, the Buyer may escalate the case to SWIFTCRED.EU. Our team will review the discussion and available evidence. If necessary, we may request additional information or check the Product’s validity with third-party platforms, where technically possible.

10.5. Determination of Outcome

As a result of the review:

  • If the Buyer’s claim is clearly justified, we may issue a refund or facilitate a replacement.
  • If the claim is clearly unfounded, it will be rejected with justification.
  • If the outcome is unclear, we may propose a compromise.

10.6. Evidence Disclosure

SWIFTCRED.EU may refer to the submitted evidence when explaining its final decision, unless confidentiality or legal duties prevent disclosure.

10.7. Disagreement with Outcome

If you disagree with the outcome, you may raise a formal complaint or seek legal redress through the competent courts of Estonia.

11. COMPLAINTS

11.1. Contact Information

Users are encouraged to submit all complaints, questions, and suggestions to SWIFTCRED.EU via email [email protected]. If you are a Merchant, you may also contact your assigned account manager.

11.2. Complaint Details

To expedite the resolution of complaints, please include all relevant details such as your login, a clear description of the issue, your preferred contact method, and a suggested solution. Where possible, attaching screenshots or supporting material is advised. If further information is needed, SWIFTCRED.EU may request it before proceeding.

11.3. Complaint Handling

Complaints will be processed through SWIFTCRED.EU’s internal resolution procedures by qualified support staff in a timely, fair, and professional manner. For Consumers, a response will be provided no later than 14 days after the complaint is received, or within 14 days after any additionally requested information is provided. For all other Users, responses will be given without undue delay. If the complaint is upheld, appropriate corrective actions will be taken, which may include reversing a prior decision or applying remedies.

12. LIABILITY AND INDEMNITY

12.1.1. General Terms

The terms in this section apply to the maximum extent permitted by law of Republic of Estonia. Users with doubts about their rights under these T&C or applicable law should contact us at [email protected].

12.1.2. Disclaimer and Limitation of Liability

To the fullest extent permitted by law:

  • SWIFTCRED.EU provides all services “as is,” without any express or implied warranties, including but not limited to warranties of merchantability, suitability, or fitness for purpose.
  • SWIFTCRED.EU disclaims any liability for:
    • Losses related to force majeure (including acts of God, power failure, legal restrictions, etc.);
    • Third-party platform issues, hacking, or interruptions caused by external providers;
    • Unauthorized access to a User’s Account due to the User’s own negligence;
    • Any indirect, consequential, or incidental damages including loss of profits, business interruption, or loss of goodwill;
    • Defects in hardware or software not attributable to SWIFTCRED.EU.

12.1.2. Exceptions to Liability Exclusions

These exclusions do not apply where prohibited by law. Specifically, they do not limit liability for:

  • Intentional misconduct or gross negligence by SWIFTCRED.EU;
  • Breach of express guarantees where prohibited from limitation under law;
  • Consumer remedies under mandatory provisions of the Consumer Protection Act.

13. CHANGES TO THE PLATFORM & CHANGES TO THE T&C

13.1. Effectiveness of T&C

These Terms and Conditions (“T&C”) shall become effective as of the date of their publication and shall remain binding until amended or terminated, subject to the laws of the Republic of Estonia and other provisions outlined herein. If amendments to these T&C require prior consent under applicable law, the effective date for each Consumer shall be the date they provide such consent.

13.2. Amendment Notice

Amended T&C published in advance 15 days before the changes take effect. Users who disagree with the changes may terminate the agreement and close their Account at any time prior to the effective date of the new T&C or thereafter.

13.3. Changes Not Requiring Amendment to T&C

The following changes, being inherent to the nature of an online marketplace, may occur at any time without requiring modification to the T&C, and shall not affect already concluded or pending transactions:

  • Sellers may add, remove, or update Products offered on the Platform.
  • Product categories may be reorganized or renamed, including introduction of new labels, filters, and recommendations.
  • Seller promotion mechanisms may be modified or replaced (e.g., featured placement, ranking methods, AI-enhanced suggestions).
  • The Service Fee may change dynamically, with the current amount always disclosed to Users at checkout. 
  • Available payment methods may be updated due to changes in payment service providers. Any new payment requirements or verification steps will be disclosed at the time of purchase.
  • Platform features may be altered, removed, or introduced (including updates to the user interface or addition of new services), to enhance user experience, security.

14. FINAL PROVISIONS

14.1. Communication

Unless otherwise required by applicable law to be in writing, all communication between the Platform and Users shall be conducted via email or through the Customer Support portal. All required invoices or receipts will be issued electronically. Users may contact us at [email protected].

14.2. Independent Contractors

SWIFTCRED.EU and each User are independent contracting parties. Nothing in these Terms shall be interpreted as creating a relationship of agency, partnership, joint venture, employment, or franchise between the parties.

14.3. Invalidity of Provisions

If any provision of these Terms is found to be invalid, illegal, or unenforceable under law, that provision shall be deemed severed and shall not affect the validity or enforceability of the remaining provisions.

14.4. Governing Law and Dispute Resolution 

14.4.1. Governing Law

These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of Estonia.

14.4.2. Dispute Resolution

Any disputes, controversies, or claims arising out of or in connection with these Terms, including their existence, validity, interpretation, performance, breach, or termination, or any disputes regarding non-contractual obligations arising from or related to use of the Platform, shall be referred to amicable negotiation as a first step.

14.4.3. If Negotiations Fail

If such negotiations fail, the dispute shall be submitted to the competent courts of the Republic of Estonia, unless mandatory provisions of consumer protection law require resolution via alternative means or grant jurisdiction to specific authorities or tribunals. This clause shall not restrict any Consumer from exercising their rights under applicable mandatory law.

14.4.4. Consumer Rights and Legal Proceedings

Consumers are encouraged to contact us at [email protected] prior to initiating any legal proceedings to allow an opportunity for informal resolution.

14.5. Language of the Terms

These Terms and Conditions are drafted in English, which shall be considered the authoritative version in the event of any conflict or discrepancy with translated versions. Given the international nature of the Platform, English shall prevail as the governing language for interpretation of these Terms. If Users have any questions about their rights and obligations, they are encouraged to contact Customer Support.
